Why Must Post Placement Reports be Sent to the CCAA?

1. Requiring adoption agencies to submit post placement reports is a concrete method of fulfilling the responsibility bestowed upon the China Center of Adoption Affairs (CCAA) by the Chinese government.
¡¡¡¡The State Department¡¯s legal office and the Civil Affairs Bureau¡¯s law interpretation clearly indicate that one of the CCAA¡¯s assumed responsibilities, in its international adoption activities, is to closely follow and understand the situations of our adopted Chinese children and their adoptive families. Currently the CCAA assumes the task of post placement reports as one of the most important foundations to assess adoption agencies, which is one of the necessary conditions of continued cooperation between the CCAA and adoption agencies.

2. Requiring adoption agencies to submit post placement reports is a necessary measure to protect the rights and interests of children.
¡¡¡¡As is commonly known, children¡¯s age and extent of maturation determine that they are a vulnerable group of society. They need special protection and care. Individual countries¡¯ laws as well as international treaties indicate corresponding stipulations to protect children¡¯s rights and interests. China¡¯s ¡°Adoption Law¡± stipulates that ¡°adoption should be beneficial for the care and growth of minor adoptive children.¡± The United Nations¡¯ ¡°Convention on the Rights of the Child¡± also stipulates that ¡°in the course of all adoptions and intercountry adoptions, children¡¯s best interests shall be considered above all.¡± We require foreign adoption agencies to submit post placement reports in order to implement and concretely reflect the purpose of ¡°Everything for children,¡± which is the necessary measure to protect the rights and interests of children. In completing post placement reports, foreign adoption agencies must designate a social worker to visit the adoptive family¡¯s home, and this kind of visit and discussion with the family is the process of guidance and help for the adoptive family, thus providing in one aspect, an understanding of the adoptive child¡¯s life and growth situation, and in another, assistance to address any difficulties on the part of the adoptive family. This will assist adoptive families to quickly build an attachment with their adopted child and blend their family.

3. Requiring the adoptive country¡¯s adoption agencies to submit post placement reports is the domain and consistent practice of the intercountry sending adoptive country.
¡¡¡¡In our understanding, sending countries such as Korea, the Philippines, India, Russia, Romania, and Chile, etc., following an intercountry adoption, all require the adoptive country¡¯s adopters or adoption agency to provide a post placement report for the adopted child. This provides a comprehensive understanding of the adopted child¡¯s adoptive family and growth situation. The situation is closely followed for as long as 18 years or as short as six months.
¡¡¡¡The International Council on Social Welfare¡¯s 27th Global Conference ratified the ¡°Implementation Guidelines for Charge of Domestic and Intercountry Adoption and Adoption Families¡± stipulation: ¡°As soon as a child is placed for adoption, the directing authorities or commissioned organization must:
¡¡¡¡1) Accept the task of supervision; and
¡¡¡¡2) Within the period of both parties coming to an agreement, provide to the directing authorities or commissioned organization of the child¡¯s country of birth a report relating to the child¡¯s development situation.
¡¡¡¡This is also to say that in the course of an intercountry adoption, the international general tradition, even as adoption relationships develop, after the adopted child leaves the country of his/her birth, is that the adoptive country¡¯s correlating organization or government department has the duty to provide a report on the child¡¯s growth and development. The ¡°Convention on Protection of Children and Cooperation in Respect of Intercountry Adoption,¡± also known below as ¡°The Hague¡¯s¡± twentieth article is: ¡°The Central Authorities shall keep each other informed about the adoption process and the measures taken to complete it, as well as about the progress of the placement if a probationary period is required.¡± China has become a formal member of this Convention, and depositing and keeping post placement reports is a duty that must be implemented by ¡°Hague Convention¡± member countries.

4. Requiring adoption agencies to submit post placement reports helps adopted children to understand their adoption and identify with their adoption in an effective manner.
¡¡¡¡The practice of intercountry adoption work has already proven that adopted people have the right to understand their adoption and identify with their adoption in order to cultivate a healthy psyche, have a strong and sound character, and help them to grow up healthy. Post placement reports as well as adoption records have an irreplaceable role in helping adopted children to understand and identify with their adoption.
